Caught in the breach

Article Abstract:

A case involving breach of contract will be judged by the UK House of Lords. The case involved a swimming pool which was a few inches too shallow. A court initially awarded the client 2,500 pounds sterling for loss of pleasure since the pool could still be used for diving. This judgement was overturned by the Court of Appeal which awarded the client 21,560 pounds or the cost of rebuilding the pool. The case will be judged by the House of Lords. If the decision is not overturned, clients can complain about a single brick, and be paid the cost of rebuilding the house, even if they never intend to rebuild it.

How to cheat with concurrent delays

Article Abstract:

It is difficult to determine who is responsible when delays in a contract have occurred in more than one subcontract. Each individual subcontract delay could have been responsible for the whole job to be delayed but all should share the liability. Common sense dictates investigating the main cause of the final delay but to apportion blame for all the preceding and related delays can be costly and ineffective. The methods for calculating the amount of delay each subcontractor is responsible for are not simple as they appear.
