Land's End takes guarantee dispute to EU

Article Abstract:

Land's End Inc has filed a complaint with the European Commission over the refusal of German courts to allow it to advertise its unconditional guarantee in Germany. A German appellate court has ruled that the cataloger can offer its guarantee but not to advertise it since doing so violates a 1932 German law. In the complaint filed with the commission, Land's End argued that the German law is in conflict with the European Union's (EU) recent e-commerce directive and that the EU law should prevail.

Article Abstract:

The proposed merger between Karstadt AG, Germany's leading department store chain, and Schickedanz Group's mail-order business would create a more forbidable challeger to Otto Versand, the number 1 German mail-order house and the world's largest. Schicekdanz's Quelle and Karstadt's Neckermann, Germany's second- and third-leading mail-order houses, respectively, had combined sales of just below DM15 billion ($8.3 billion) in 1998. The two mail-order brands will retain their identity.
