Article Abstract:

Contractors have an absolute obligation to ensure structures are fit for purpose. The structure must meet all the external objectives of the employer as well as the performance objective, whether implied or expressed. A fitness for purpose obligation may be incorporated in any of the contract documents, such as performance specifications or contract conditions. The contractor may refuse to accept such obligations as they may make the project uneconomical, there may be confusion over areas of responsibility or there may be problems in obtaining insurance cover for consultants.

Possession and ownership. (rights of ownership of documents)

Article Abstract:

Rights of ownership of documents between employer, contractor and consultant depend on the purpose for which the documents were generated. Documents written by a consultant to contractors are generally regard as the client's property. A distinction is made between documents giving professional advice, although there is no clear definition of 'working papers'. Right to ownership enables the owner to issue proceedings.
