Rough justice is still justice

Article Abstract:

British Judge Mr Justice Dyson has pointed out the UK government must have realised the way the adjudication procedure had been set up in the UK Construction Act would lead to incidents of poor justice. Although some parties may feel unfairly treated they are able to challenge the decision through either arbitration or by going to court. Decisions made by adjudicators for the construction industry often are inconsistent but all parties should accept some decisions will be unfair and abide by those decisions.

The new JCT80

Article Abstract:

The UK construction industry Joint Contract Tribunal issued its JCT80 standard in April 1998, which brings contract legislation in line with the Construction Act 1998. One of the main points of JCT80 is the information release schedule agreement which must be drawn up at the beginning of a contract. The payment of 5% over base rate charges must be paid to subcontractors if contractors make late payments. Arbitration in disputes involving late payment and time scales is also included in JCT80.

Is the act bankrupting us?

Article Abstract:

The construction industry appears to have seen a rise in the number of firms becoming insolvent since the introduction of the Construction Act and despite increased orders. The Act was intended to solve the problem of cash flow within the industry.
