The general product safety directive

Article Abstract:

The European Community (EC) general product safety directive will not be implemented at the end of 1992 as planned, because a two-year extension has been granted by the Council of Ministers. The extension gives individual EC members time to adapt their laws. The directive involves three levels, with some products not specifically dealt with under EC rules, some dealt with under new types of rules, and some dealt with under other rules. The actors involved, such as distributors and producers, are defined, as is the concept of a consumer product.

Article Abstract:

The EC (European Community) General Product Safety Directive places limitations on product coverage, which will cause difficulties in member states. The EC has failed to make the directive general enough to include coverage of product gaps left in the implementation of specific EC product safety rules. Product coverage is tested using the 'intended or likely consumer use' test, the 'commercial supply' test and the 'specific' EC rules' test. If there are no specific rules governing a product then the directive should apply.

1974 revisited

Article Abstract:

The Framework Directives for implementing EC workplace health and safety rules are the most important safety regulations since the 1974 UK Health and Safety at Work Act. The new rules require companies with five or more employees to establish and implement a written safety policy. An ongoing assessment program to identify possible hazards and preventative measures is also required. A breach of the regulations exposes a company to civil damages.
