Will drug testing pass or fail in court?

Article Abstract:

Atty. Larry Michaels explains that applicant drug testing and testing on reasonable suspicion are the types of employee drug testing that is most favored by the courts. Compared to the two, random testing is not as acceptable because it is viewed by the courts as being intrusive into employees' right to privacy. Employers that want to avoid lawsuits stemming from drug testing should carefully weigh their need for information against the employees' expectations of privacy. A strong business justification for drug testing is present when employees subject of drug tests have a function that involves public health or safety. These are jobs that may threaten public safety if employees are under the influence of drugs.

Management techniques fail to deliver

Article Abstract:

A survey of the use of 12 management techniques such as TQM and outsourcing in 564 manufacturing companies indicates that the strategies have not always been effective. The management practices are most frequently employed to improve quality, reduce cost and increase customer responsiveness. In more than 50% of the responses there was an indication that the techniques had failed and even where there were successes the potential for failure had been high.

Four leading causes of budget failure are manipulation, incomplete variance explanations, blaming others or distorting figures, and failure to recommend solutions to problems.
