Expanding the scope of malpractice

Article Abstract:

Employers and health plans expect a barrage of legislation intended to regulate managed care and other health plans, with the increasing importance of health care as a consumer issue. These proposed legislation would allow malpractice lawsuits to be lodged against the medical director or claims administrator of a plan. Under such bills as the proposed Patient Access to Responsible Care Act, a plan and its employees can be brought to court for wrongful death and bodily injury. These bills are not only seen to encourage defensive medicine, but are also predicted to inflate health care costs.

Insurers fight back on health care

Article Abstract:

Health insurance companies are launching an all-out lobbying campaign to thwart the proposed Patient Access to Responsible Care Act (Parca) in Congress. Criticized by the industry for being anti-managed care, Parca is expected to increase health premiums. Various trade groups representing the managed care and indemnity insurance sectors are setting aside huge budgets for print advertising and grassroots mobilization. These political activities are led by The Health Benefits Coalition, formed by health insurers to fight any proposed changes in the health insurance system.
