A new look at trade shows, pre-sales promotions; such activity may be enough for a court to determine a protectable interest in a mark

Article Abstract:

Issues are discussed regarding whether advertising a trademark through pre-sales activity such as trade shows, in trade magazines and on a company's Web site suffices to justify superior trademark rights in the mark. The assessment should also include whether a party has received orders for the product or engaged in beta testing.

Issues are discussed concerning the business-to-business Internet marketplaces, commonly called B2B exchanges. These focus predominantly on either vertical or horizontal markets, with the former automating the procurement process for an industry, while the latter focuses on providing goods and services to various industries or marketplaces.

Copyright law; fair use and the Internet

Article Abstract:

Rulings that the fair use doctrine does not include online, unauthorized sampling of copyrighted music are discussed. Rulings have come at the trial court level, and upholding of these judgments by appellate courts could subvert the foundation of copyright protection and the industries that rely on it.
