Conditional federal grants: can the government undercut lobbying by nonprofits through conditions placed on federal grants?

Article Abstract:

The Simpson and Istook amendments are constitutional violations forcing 501(c)(3) and 501(c)(4) organizations receiving federal funds to either continue doing so or waive their free speech rights. The Simpson Amendment, part of the Lobbying Reform Act, makes recipient organizations choose either to continue being able to lobby or continue receiving federal funds, a constitutional violation. The Istook Amendment would, if enacted, place so heavily condition an organization's lobbying activities that lobbying would have to cease.

Empowerment lawyering: the role of trial publicity in environmental justice

Article Abstract:

Making the concerns of their clients public is an important part of the job for environmental poverty attorneys. Such lawyers must be cognizant of legal ethics rules about trial publicity but 1994 Model Rule 3.6 protects both speech and fair trials and enables environmental poverty lawyers to do their job fully. Attorney comment must inspire others to act and help fight the battles of environmental racism.
