Establishing the International Tribunal for the Law of the Sea

Article Abstract:

The UN Convention on the Law of the Sea establishing the International Tribunal for the Law of the Sea (ITLOS), a 21-member elected body, and the Sea-Bed Disputes Chamber. The ITLOS dispute settlement procedures have been the source of controversy. As of Apr 1995, only five countries had chosen ITLOS as their preferred dispute resolution procedure, with most nations instead opting for arbitration or International Court proceedings.

Forum Prorogatum and the advisory proceedings of the International Court

Forum prorogatum is a doctrine stating that a court's jurisdiction may be extended by agreement of the parties to a proceeding. The author examines the International Court of Justice's usage of the doctrine in giving advisory opinions.
