Perils of 'Prozac probes;' mental health, substance abuse inquiries still plague bar applicants

Article Abstract:

The controversy over bar examiners' probing an applicant's history of mental health, substance abuse or alcoholism problems before admitting them to the bar is discussed. Several suits charge this is an invasion of privacy and violation of the Americans with Disabilities Act.

Attorney Alan Dershowitz's suit to obtain the fees he claims he was promised for consulting with the Florida attorneys trying the tobacco industry case against the state and researching possible federal causes of action should the case fail in state courts is discussed.

Satisfaction or your money back; ruling says fees may be forfeited if client is unhappy with attorney conduct

Article Abstract:

The Texas Supreme Court's holding in Burrow v. Arce is discussed, a case which ruled that forfeiture of fees is the remedy for attorneys who breach their fiduciary duties to clients, even if the clients suffered no actual damages. With this case, the court lowered the bar for malpractice actions, effectively eliminating the usual requirement that the case would have been won had it not been for the attorney's malpractice.
