The key to state 'unbundling' plans, which let consumers choose their natural gas providers, is to create a level playing field on which marketers can compete

Article Abstract:

Federal and state governments are attempting to unbundle the sale of natural gas from its transmission. They hope to increase competition among gas marketers and ensure lower costs to consumers, while maintaining a reliable distribution system. The success of their deregulation efforts will depend on how well they guarantee equal competition between outside gas marketers and current local distribution companies, especially in the residential market. The extent to which states have implemented deregulation varies, some relying on public utility commissions and others on legislation.

Dynamic interpretation or administrative repeal?: the SEC's promulgation of Rule 58 to deregulate the Public Utility Holding Company Act of 1935

Article Abstract:

The promulgation of Rule 58 by the Securities and Exchange Commission (SEC) falls within the agency's statutory authority to interpret the Public Utility Holding Company Act of 1935 (PUHCA). Rule 58 allows some non-utility acquisitions to be exempted from regulation under the PUHCA. The U.S. House Committee on Commerce has questioned whether this rule represents an attempt at administrative repeal of the PUHCA, but it should be considered within the SEC's legitimate authority to adapt to changes in circumstances affecting the utility industry.

The regulatory life cycle and regulatory concerns for the utilities of the Northern Mariana Islands

Article Abstract:

The proposed privatization of public utilities of the Northern Mariana Islands is discussed. The enactment of a regulatory commission to oversee utilities in the Commonwealth is suggested, and the role of the Commonwealth government in choosing a model for privatization is outlined.
