Public records held by private agencies must be reasonably accessible to public

Article Abstract:

The Supreme Court of Arkansas ruled in Swaney v. Tilford that the Arkansas Development Finance Authority must ensure reasonable public access to public records related to the agency that are not in the agency's possession or control. The Authority had claimed that it could not fulfill public records requests for audit working papers because the auditing firm, Deloitte & Touche, was in possession of the documents. The accounting firm denied requests based on client confidentiality. The court found that the agency must take steps to ensure that the records held by the private party are made available.

Legislation limits access to driver records

Article Abstract:

Congress passed the Drivers Privacy Protection Act in 1994 to compel states to restrict access to personal information found in motor vehicle records. States will be required to implement appropriate restrictions and policies by Sept 1997. Insurance companies, government agencies and private investigation services would be allowed access, though businesses could not use the information for marketing purposes. Some states have already restricted access to these records, but few have implemented the federal legislation.
