Competition policy and anti-dumping: is it time for a reality check?

Article Abstract:

Several proposals for developing an international framework for competition policy include suggestions for making anti-dumping procedure and practice more uniform with competition theory principles. However, debate continues on the type of changes that are possible and should be attempted. The consideration of changing or replacing anti-dumping rules in discussions of international competition rule is inherently difficult, so discussions may be more productive if focus is directed towards more traditional domains of competition policy.

Settling competition-related disputes: the arbitration alternative in the WTO framework

Article Abstract:

An approach that is limited and based on present experiences serves as a perfect alternative in solving competition-related trade conflicts. It resolves conflicts through unification of various basic and general substantive rules from which a great number of competition policies are based. The approach also finds solution to problems related to market access through utilization of a dispute settlement system.
