The use of testimony by physicians in civil and criminal proceedings since the US Supreme Court's 1993 Daubert v. Merrell Dow Pharmaceuticals, Inc. decision is discussed. Topics include barriers to more informed application of scientific evidence in law.

Evidence-based medicine and the law: the courts confront clinical practice guidelines

The author discuses how the courts are likely to apply clinical practice guidelines in health case litigation addressing quality-of-care and entitlement-to-benefits claims. The problem of conflicting guidelines and the political aspects of guides lines are addressed.

What does evidence mean? Can the law and medicine be reconciled?

The author discusses the role of evidence-based medicine in clinical decision-making by physicians. Tensions between the law and medicine with respect to the concept of evidence are analyzed and possible improvements in the process are suggested.
