Article Abstract:

Changes to English and Welsh land registration procedures are being proposed to cope with the introduction of electronic conveyancing. The new electronic system will make the procedure much quicker. The current three-stage procedure can lead to legal difficulties between transfer of land and legal ownership. The Land Registry and the Law Commission have published a plan with their idea of conveyancing in 2008. They also note several problem areas will have to be tackled before an electronic system is initiated, such as coping with technology faults and stopping fraudulent registration.

Overriding importance

Article Abstract:

The UK Landlord and Tenant (Covenants) Act 1995 will enable landlords to grant an overriding lease to an ex-tenant, making him the landlord of the current tenant, and allowing him to retake control of premises if he settles the rent and payments due by the current tenant in cases of default. The landlord will be able to choose whether or not to accept an overriding tenant. Former tenants can make a claim on such property by requesting an overriding lease in writing.

Solicitors' duty of care

Article Abstract:

There have been a number of cases recently in the UK which have been concerned with the duties of solicitors acting for intended mortgagees of real property. The ruling in one case indicates that the duty of a solicitor to a third party in tort is likely to be less onerous than a duty in contract, while the ruling in another related to the difficulties facing a solicitor in attempting to verify the true identity of a client.
