Planning for conflicts of interest in land use decisionmaking: the use of alternate members of planning and zoning boards

Article Abstract:

Conflicts of interest are becoming more common when planning and zoning boards vote on land use issues. Recusals can result in tie votes or the lack of quorums. Therefore, local boards should adopt procedures for the appointment of alternate board members or for the temporary substitution of other boards when needed.

Telecommunications Act of 1996: developments in the ongoing conflict between service providers and local home rule in the facilities siting context

Article Abstract:

The authors discuss the Telecommunications Act of 1996, protections the act offers service providers in their attempts to site facilities when faced with local legislation denying permits, damages for violations under the act, and their experience in trying a case appealing a local denial of permit.

Compact planning offers a fresh approach for regional planning and smart growth: a New York model

The authors discuss New York State's approach to regional planning, which uses incentives to encourage voluntary participation by local governments. The elements of the proposed New York State Planning Compact Act are analyzed.
