Can hate be controlled? A clouded issue

Article Abstract:

The US Supreme Court's plurality decision striking down St. Paul's hate crimes ordinance on void for vagueness and lack of viewpoint and content neutrality grounds symbolizes disagreement on why and what speech merits constitutional protection. Opinions from some of the 46 states with hate legislation following the St. Paul decision and considering the constitutionality of sentence enhancements for bias-motivated crimes show that the Supreme Court's analysis has done little to clarify the blurred distinction between punishing acts and protecting speech.

Article Abstract:

The First Amendment, the courts and the American Indian Religious Freedom Act of 1978 have done a poor job of protecting Native Americans' religious liberty. More than 60 Native American religious sites on government land are in danger of destruction. Native American religions often relate to specific sacred sites and so the sites' destruction often leads to the obliteration of the culture. The American Indian Religious Freedom Coalition is lobbying for amendments to give the American Indian Religious Freedom Act added strength.
