Separatist religious groups and the Establishment Clause

Article Abstract:

The US Supreme Court's use of a neutrality test for an Establishment Clause violation in Board of Education of Kiryas Joel Village School District v. Grumet demonstrates the Court's inability to fashion a workable alternative to the test established in Lemon v. Kurtzman in 1971. The Court has often avoided apply the Lemon test, in part because a majority of the Court would reject the test. In the present case, in which a school district was established solely to serve a highly orthodox Jewish community, the Court applied the principle of neutrality to find the district unconstitutional.
