Article Abstract:
Mixed views are being expressed by lawyers and construction industry leaders in the UK about the Contract (Rights of Third Parties) Bill. Some observers believe that the bill is not aligned in any way with the requirements of the construction industry. They do not believe that the bill will have any impact other than to increase speculative litigation. They feel that a more focused approach is required. This approach should take the form of a properly codified construction law that would eliminate the legal uncertainties that constantly arise.

Homes stampede shows up double standards: two premature occupation cases highlight different rules for public and private building control
Article Abstract:
Rules governing public and private sector building control are being called into question in the light of two recent premature occupation cases. Bellway Homes, which allowed purchasers to move into an unfinished development near London's Tower Bridge, faces being convicted and fined for breaching the 1984 Building Act, but Linden Homes is unlikely to be punished for allowing buyers into an unfinished housing estate in Sutton because the rules governing the public and private sector are different.
