Builders are responsible for checking that the people they are working with do not make costly errors, according to a recent High Court case. The case concerned a surveyor's drawing which indicated that the walls to be taken down were non-loadbearing when in fact they were loadbearing. The client, Edward Lindenberg, blamed the builder, Joe Canning, saying that the oral contract between himself and Canning contained an implied term that Canning owed him a reasonable standard of care. To judge the standard of care required, the law does not ask if the builder noticed a mistake and did not report it, but whether he should have noticed the mistake and reported it.

Article Abstract:
The construction industry in the UK has told parliament it wants an instant dispute adjudication system to be included in building contract and professional services. The industry has also asked for a new cash-flow and payment system. If contracts do not include payment and adjudication rules, then the scheme, as it has become known, will be imported into the contract automatically. The scheme will become part of the Housing Grants, Construction and Regeneration Act, 1996.

No privileges for claims consultants
Article Abstract:
A Feb 1993 UK case 'Ryan versus New Victoria Hospital' states that claims consultants are not entitled to privilege. Privilege is limited to barristers and solcitors who are qualified, have a professional code of conduct and who owe a duty to the court. Legal privilege allows certain documents to remain secret between a solicitor and their client.
