Construction ADR: you get out what you put in

Article Abstract:

The construction manager (CM) should be prepared as early as possible for any arbitration or legal proceedings that arise from construction. The CM's role in arbitration proceedings should be contractually defined before the construction work begins. During arbitration the CM should understand the legal basis, technical aspects and financial issues involved in the dispute. The CM should be prepared to assist in document production if the dispute goes to court.

The business and legal communities look to ADR

Article Abstract:

Alternative dispute resolution (ADR) benefits the business community and improves the reputation and job satisfaction of lawyers. ADR makes more sense in business because it saves time, money and often restores a harmonious relationship between business partners. ADR's less confrontational solution methods create a more positive image for lawyers. Lawyers appreciate participating in a process where both sides win.

EEOC adopts ADR methods

Article Abstract:

The Equal Employment Opportunity Commission (EEOC) announced in April 1995 that it adopted alternative dispute resolution (ADR) techniques to resolve claims filed with the EEOC. The adoption was based on findings by an EEOC task force and pilot programs in four district offices. ADR techniques should aim to protect the public, be fair to all parties and keep arbitration discussions confidential.
