Is California's Proposition 187 pre-empted by federal laws?
Article Abstract:
California's Proposition 187 is in the courts so that its status in relation to federal immigration laws can be considered. Some claim that the law violates a constitutional requirement for immigration to be dealt with solely on the federal level, that the CA law would deny legal immigrants due process and that it would promote discrimination. Proponents of the proposition claim that it will actually make existing federal laws, such as the denial of Medicaid to illegal immigrants, more enforceable. Proponents also claim that the law would not create a deportation center controlled by the state.

Immigration reform
Article Abstract:
Three significant shifts have occurred since the 1960s that affect US immigration. The first change involved amendments to the Immigration and Nationality Act of 1952. The second was the changing national origin of immigrants while the third addressed the increasing number of illegal aliens. The government's focus on stopping illegal immigration resulted in the passage of the Immigration Reform and Control Act of 1986. This comprehensive law aims to discourage aliens by penalizing their employers while allowing millions to reside legally.

Should children born to illegal immigrants in the United States be denied birthrights to U.S. citizenship?
Article Abstract:
Controversy exists on whether or not children of illegal immigrants should have citizenship as a birthright. Legislation has been proposed to amend the US Constitution to take away this birthright. The intent of this change would be to stem the tide of illegal immigration. Opponents of the measure cite it as an attack on equality similar to slavery, in that it would deny citizenship to an entire class of people born in this country.
