Legal argument - protecting against employer insolvency

Article Abstract:

Employer insolvency is a risk that should be assessed by all disciplines of the construction industry. At pre-contract stage contractors should: try and obtain a guarantee of payment from the employer's bank or parent; carry out credit checks; investigate the employer's accounts; check the project's commercial standing and negotiate a contractual provision to suspend work and claim an extension of time. Post-contractual steps are: the contractor should inform the employer's funder which may involve receivership or package refinancing or issue a statutory demand or winding up petition against the employer.

Building waste's two legal traps

Article Abstract:

Laws regulating the disposal of waste came into force on Apr 1 92. The regulations place a duty of care on all those handling waste to ensure it is legally disposed of. All waste handlers must be registered with the local waste authority. The Joint Contracts Tribunal is investigating the amendment of its standard forms of contract to enable a contract to be continued when a contractor becomes insolvent if it goes into receivership.
