Article Abstract:

It can often be hard to establish where the responsibility for the health and safety of peripatetic works lies. In some cases, the responsibility lies with the provider employer, in other cases with the host employer and in other cases with more than two employers. It is therefore vital that all employers of peripatetic workers, in whatever role, establish exactly where their responsibilities lie. It will probably be necessary to establish flexible arrangements for deal with a number of different cases.

Article Abstract:

Product risk assessment is a constant process which management and manufacturers should undertake to ensure the highest degree of safety. Legal action may result from inadequate risk assessment to the safety and health of those workers producing or working with the final product. It is essential to deal with any reported product risks quickly and effectively, ensuring information is passed to any groups involved in the use of the product.

Sentencing powers

Article Abstract:

Provisions for offenses and penalties made under the Health and Safety at Work Act 1974 have been modified in previous years. Magistrates' courts can only deal with certain alleged offences, while other offences can be prosecuted at either the magistrates' or crown court. Fines and not prison sentences are imposed for breaches of sections 1-9 of the act.
