It can often be hard to establish where the responsibility for the health and safety of peripatetic works lies. In some cases, the responsibility lies with the provider employer, in other cases with the host employer and in other cases with more than two employers. It is therefore vital that all employers of peripatetic workers, in whatever role, establish exactly where their responsibilities lie. It will probably be necessary to establish flexible arrangements for deal with a number of different cases.

Provisions for offenses and penalties made under the Health and Safety at Work Act 1974 have been modified in previous years. Magistrates' courts can only deal with certain alleged offences, while other offences can be prosecuted at either the magistrates' or crown court.
