EPA rulemaking under the Regulatory Flexibility Act: the need for reform

Article Abstract:

The US Congress should amend the Regulatory Flexibility Act of 1980 (RFA) so that the law can again help small business thrive in spite of governmental regulation. It might be necessary to let the public comment on agency certifications and to mandate that such certifications take place at the same time as public notice of new rulemaking. The EPA should also simplify any rulemaking which impacts small business. Society and the environment would benefit.

Ocean discharge criteria and marine protected areas: ocean water quality protection under the Clean Water Act

Article Abstract:

The authors review the powers of the Environmental Protection Agency to protect ocean waters under the Clean Water Act. They conclude that the E.P.A.'s regulation of ocean discharge is inadequate in that it does not exercise sufficient control over state actions.

Article Abstract:

The author examines the conflict between Native Americans and rock climbers over the National Park Service's closure of Devils Tower National Monument to protect Indian holy sites. Related federal cases are also discussed.
