End of the unfunded feast; aging partners are forcing firms to face the danger in traditional pension plans

Article Abstract:

Experts warn that as the dynamics of legal practice change dramatically, unfunded pensions plans threaten to drain some law firms and leave older partners without retirement income. With such plans retirement programs are paid from a firm's cash flow rather than from employee savings and investment vehicles, as with 401(k) plans. Some unfunded plans pre-date Social Security and they became popular after the 1974 enactment of ERISA, a law requiring uniform calculation of pension benefits for all workers and capping payments to well-paid employees.

Create malpractice-free zones; documentation and deadlines are especially important in some practice areas

Article Abstract:

The legal specialties each have risks for malpractice and methods of preventing them that work the best. Probate and trust work is full of malpractice risks, accounting for 7.6% of the malpractice claims from 1990-95 in an ABA malpractice study. Improved documentation procedures could have prevented many of these claims. Conflict claims and missed deadlines are the risk in intellectual property, and the risk of facing a class action that of debt collection work.

The pause that refreshes
