Construction Bill focuses on issue of latent defects

Article Abstract:

A Construction Bill is being developed for the UK and is likely to change laws covering latent defects. This follows recommendations from the Latham Committee which reported in July 1994. There is a need to clarify the law on this issue, while giving protection to clients. Apportionment of fault is recommended instead of costs and damages born by all defendants. A compulsory insurance scheme is opposed by the UK government and a voluntary scheme is recommended.

Article Abstract:

The UK's new Construction (Design and Management) Regulations 1994 came into force in March 1995 as amendments to the Health and Safety at Work Act 1974. The new rules impose legal obligations on construction contractors who can be penalised for non-compliance. The law relates to all building work, ranging from demolition to decoration and is aimed at improving health and safety in the construction industry. Guidance on the new rules is presented.

Building on borrowed time

Article Abstract:

It was previously believed that independent contract administrators had to be appointed by employers to decide reasonable extensions of time for finishing civil engineering or construction contracts. However, as a result of the findings of two court cases, it seems that such action may be unnecessary. Details of the two cases are presented and the consequences for the arbitration process are discussed.
