Dispute resolution under the Arbitration Rules for the Real Estate Industry (Including a Mediation Alternative)

Article Abstract:

The American Arbitration Assn (AAA) will settle real estate disputes for parties that mutually agree to have their disputes resolved under the association's rules. Disputants may submit to mediation, before proceeding to an arbitration proceeding. Mediation offers the advantages of informality and confidentiality. If mediation is not successful, disputants can proceed to arbitration. Information on AAA arbitration proceedings is presented.

Mediating land use disputes: part 1

Article Abstract:

The traditional hearings process by which planning and zoning authorities resolve land-use disputes is fraught with problems. Mediation is a process that, used as an adjunct to hearings, can ease the dispute-resolution process. The mediation process is described, and its advantages and disadvantages are listed. The advantages of mediation include cost savings, a reduced chance of litigation, and improved community relationships.

There are many legal issues that need to be addressed when private party dispute resolution proceedings are used to settle real estate claims. The use of mediation, appraisal or arbitration can result in problems such as those related to ambiguity caused by incomplete documentation. Other problem areas include defining the roles and responsibilities of decision makers and how the resolution process is to proceed.
