Article Abstract:

The plan of the UK Secretary of the Department of the Environment and Trade to establish two new national parks has upset local authorities and residents in the New Forest and South Downs, although it has pleased walkers. National park status puts land under the control of the national parks authority, and affects development rights including householder development, and will take away the planning powers of local authorities.

High noon at the High Court

Article Abstract:

Applications to the UK High Court for the reversal of a planning decision made by a local planning authority are either statutory appeals under part 12 of the Town and Country Planning Act 1990 or applications for judicial review under the courts' supervisory jurisdiction. Statutory appeals may challenge a wide range of decisions, including the validity of structure plans, waste loan plans and unitary development plans. It is important to bear in mind that even a very good case may not necessarily be successful. Courts are reluctant to become involved in the decision-making of a local authority or the Secretary of State.

Article Abstract:

The UK planning system is to be reviewed by the government in an attempt to up date legal practices relating to compulsory purchase orders. Land acquisition practices are complex and slow due to the large number of separate processes which make up a compulsory order purchase. Rights creation legislation will be essential for ensuring local authorities can obtain a purchase, such as in the case of road construction or service maintenance.
