Pre-packaged software: royalties or sale of goods?

Article Abstract:

The Organization for Economic Cooperation and Development has stated that payments for pre-packaged software should be considered income from the sale of goods and not royalties, but the IRS has not yet adopted this position. If such revenues are not royalties, payments to foreign licensors are not subject to withholdings taxes. US companies should withhold taxes until the IRS provides further guidance or should make arrangements under applicable tax treaties to obtain net income taxation.
